Township Acquires Development Rights for 44 Tindall Road

AN ORDINANCE (2024-11) OF THE TOWNSHIP OF ROBBINSVILLE, COUNTY OF MERCER, STATE OF NEW JERSEY, AUTHORIZING THE ACQUISITION OF THE DEVELOPMENT RIGHTS FOR AND AN AGRICULTURAL CONSERVATION EASEMENT OVER REAL PROPERTY COMMONLY DESCRIBED AS 44 TINDALL ROAD IN THE TOWNSHIP OF ROBBINSVILLE, DESIGNATED AS BLOCK 8.07, LOT 10 ON THE TAX MAP OF THE TOWNSHIP OF ROBBINSVILLE

WHEREAS, the Township of Robbinsville, County of Mercer, State of New Jersey, wishes to acquire the development rights for and an agricultural conservation easement over real property located at 44 Tindall Road, more commonly described as Block 8.70, Lot 10 on the Tax Map of the Township of Robbinsville, Mercer County, consisting of farmland measuring approximately +/- 12.34 Acres (“Property”), from Down Home 2, LLC (“Seller”) for the total purchase price of One Million Seven Hundred Thousand Dollars and No Cents ($1,700,000.00) pursuant to N.J.S.A. 40A:12-1 et seq. generally, and N.J.S.A. 40A:12-3, 40A:12-4 and 40A:12-5 specifically; and

WHEREAS, the Property possesses natural, scenic, agricultural, and open space values of great importance to the people of the Township of Robbinsville, values the Township and Seller intend to preserve in perpetuity; and

WHEREAS, the Chief Financial Officer has certified that funding for this purchase is available in account number T-12-56-900-010-001; and

WHEREAS, this Property is being acquired for the legitimate public purpose of farmland preservation and conservation.

NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Robbinsville, County of Mercer, State of New Jersey, as follows:

1. The acquisition of the development rights for and an agricultural conservation easement over 44 Tindall Road, more commonly described as Block 8.07, Lot 10 on the Tax Map of the Township of Robbinsville, Mercer County, consisting of farmland measuring approximately +/- 12.34 Acres, for the total purchase price of One Million Seven Hundred Thousand Dollars and No Cents ($1,700,000.00), subject to the terms and conditions of the Contract for Sale of Development Rights and Agricultural Conservation Easement negotiated by and between the Seller and the Township is hereby authorized, and the Mayor, Township Clerk and Township Attorney are hereby authorized to sign said Contract and such other documents necessary to effectuate closing, including obtaining any and all necessary subdivisions, inspections, title insurance, and surveys and subject to the Township receiving clear and marketable title.
2. This Property is being acquired for the legitimate public purpose of farmland preservation and conservation.Ordinance 2024-11 Township of Robbinsville County of Mercer
3. All ordinances or part of ordinances or resolutions that are in conflict with the provisions of this Ordinance are repealed to the extent necessary.
4. If any article, section, subsection, term or condition of this Ordinance is declared invalid or illegal for any reason, the balance of the Ordinance shall be deemed severable and shall remain in full force and effect.
5. PASSED: ADOPTED: This Ordinance shall take effect after publication and passage according to law.
