Proposed Revision of Brush Collection Ordinance

Please note the propsoed revisions to ordinance 2017-8 regarding brush collection, specifically as it pertains to commercial brush work done on private property.

There will  be a public hearing and vote at the next Council meeting on April 13, 2017. 
Township of Robbinsville (Introduced) Ordinance 2017-8 County of Mercer:

AN ORDINANCE OF THE TOWNSHIP OF ROBBINSVILLE, MERCER COUNTY AMENDING CHAPTER 220 OF THE CODE OF THE TOWNSHIP OF ROBBINSVILLE, ENTITLED "SOLID WASTE MANAGEMENT," SPECIFICALLY

SECTION 220-9 (A) AND (D) ENTITLED "COLLECTION SCHEDULE" AND 220-10 (H) AND (I) ENTITLED PREPARATION OF MATERIAL FOR COLLECTION

NOW THEREFORE, BE IT ORDAINED by the Township Council of the Township of Robbinsville in the County of Mercer, State of New Jersey that Chapter 220, "Solid Waste Management" Section 220-9 (A) and (D) ENTITLED "Collection Schedule" and 220-10 (H) and (I) entitled "Preparation Of Material For Collection" of the Code of the Township of Robbinsville is hereby amended as follows [additions are underlined; deletions have strikethroughs]:

SECTION 1.

§ 220-9. Collection Schedule.

A. The Township will collect vegetative material between April and October November of each year. Leaf collection shall occur during November and December of each year.

D. Brush may be dropped off between November and March all year round at a dropoff location to be determined by the Director of Public Works the Public Works Facility located at 56 Robbinsville Allentown Rd., during such hours as designated by the Director of Public Works.

§ 220-10 Preparation of material for collection.

H. No commercial trimmings shall be collected. Brush and trimmings created by a private company such as a commercial landscaper or tree removal service working on a residential property shall not be eligible for municipal collection or drop-off. The company who provides the service shall be responsible for disposal of the brush and trimmings.

I. Brush and trimmings from commercial businesses in town are not eligible for municipal collection or drop-off

SECTION 2.

All ordinances or parts of ordinances inconsistent with or in conflict with this ordinance are hereby repealed to the extent of such inconsistency. Township of Robbinsville Ordinance 2017-8 County of Mercer

SECTION 3.

If any section, paragraph, subdivision, clause or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged and the remainder of the Ordinance shall remain valid and effective.

SECTION 4.

This ordinance shall take effect upon final passage and publication according to law and shall not be deemed in effect unless proper signage is posted.

DPW BRUSH COLLECTION POLICY

As a precaution, Township residents should always ask the contractor to produce a certificate of insurance before authorizing any work on their property. Please call the Department of Public Works at (609) 259-0422 with any questions or concerns.
