TOWNSHIP COUNCIL PASSES RESOLUTION REAFFIRMING ITS
COMMITMENT TO ACQUIRE MIRY RUN
ROBBINSVILLE, NJ - (October 2, 2017) - Township Council passed Resolution 2017-17 Thursday reaffirming the commitment it made on December 1, 2016 via Ordinance 2016-37 to acquire the real property commonly known and designated as a portion of Block 28, Lots 7,8, 11-14, 16 51 and 53, also known as the Miry Run Golf Course in Robbinsville.
The Township has determined that the acquisition of the Property is in the public interest, will enable the Township to preserve open space, and will further the goals of the Township as set forth in the Township Master Plan.
According to the Resolution, the Township may acquire the Miry Run property either through voluntary negotiations or through condemnation pursuant to the Eminent Domain Act, N.J.S.A. 20:3-1.

The Township prefers to acquire the property through voluntary negotiations and desires at this time to pursue negotiations with the property owner, Spring Garden Country Club Inc., with a view towards achieving a negotiated agreement that takes into account the reasonable objectives and interests of both parties, and which ensures that the property owner receives fair and just compensation for the property.
The Eminent Domain Act provides a procedure for a municipality to engage in formal negotiations and, in the event such negotiations are unsuccessful, to file a condemnation action and to secure a determination as to the price to be paid as just compensation in advance of the filing of a declaration of taking.
